Arbitration

4Civility arbitration training focuses on understanding the differences between arbitration styles, binding and non-binding arbitration, and the need to provide restorative closure to the parties involved.  Arbitration like other 'rights based solutions' can leave the parties to the arbitration bitter about the outcome and the process.  This bitterness can result in life long resentment and a hidden desire for revenge.  Training in restorative arbitration can allow the arbitrator to help the parties understand the process, accept the outcome, and restore their relationship with themselves and the opposing party.  This process begins with the arbitrator using emotional intelligence, active listening skills, and other mediation skills to create an atmosphere of fairness and trust.  When both parties equally develop a trusting relationship with the arbitrator then the finding in the arbitration should not be a surprise and should be accepted as fair and unbiased.  This process can allow non-binding arbitration cases to be resolved without further litigation and binding arbitration cases to be accepted as fair.
